If its in theyre care, they are responsible for it, and should replace it with theyre insurance.

Yes it's right, they should have insurance to cover stuff getting stolen. We had a bike stolen from our shop and insurance covered it. They would be mad not to have it?

they say their insurance does not cover it, so we either find it or bust! so much for introducing our 2 children (aged 2 and 7 months) to the wonderful world of camping and 4wdriving

They are trying to divest responsibility, which AFAIK they aren't technically or legally allowed to do...
If they are a registered business that sells, services and hires these things, then they have insurance to cover this sort of thing.
Did you sign a zero-liability contract?
"All Care, No Responsibility" or the like?
Take them to Fair Trade, ACCC, Small Claims, wherever.
Alternatively - if you have your own insurance on it, tell your insurance company the situation and state that it is the fault of the business, they will chase the business from a legal point of view...
Good luck!

Their insurance may not cover it, that is their problem, they need better insurance. Have a word with OCBA and put a complaint in writing to Challenge advising that you will take court action, they are trying it on I think.

Yes they are definatly trying it on.
Do not let it slide.
I for one am sick of bigger businesses trying to screw the little man.
Stand your ground and take action.
Just my 2 cents

I was thinking of hiring a camper trailer from challenge campers but after hearing this story i wont be dealing with this company and i will be telling as many people as i can to do the same. Maybe you should get the media involved eg. A current affair or today tonight. Good Luck!

Did Challenge Campers put in a Police Report for the stollen items and/or break and enter???? If so call into your local Police Station and see if you can get the job/incident number, tell them you need if for you insurance (which you will). Make sure you let your insurance company know what is going on - they may assist you.
If you have paperwork from them stating something along the lines that they had the camper trailer for repairs or whatever you have got them.
See a solicitor and take it to small claims court. Small claims court look after the little guy over big business (that legally should have the insurance anyway).
But I am sorry to say that if you do not have any paperwork then not much you can do except for contacting Challenge Campers Head Office, ask for customer support manager and state your claim.
You could go to the media but leave that to the very very very last thing as things can turn ugly when the media get involved. But it maybe the last straw for Challenge Campers to crumble!!!
With Fair Trading do not even bother unless you have tried every other avenue known to man they will not get involved. Even when they do they just send the company (Challenge Campers) a letter that they believe they should pay the customer - BUT it is still up to the Company if they pay or not. Then Fair Trading will tell you to take it to Small Claims Court. SOUNDS LIKE A BIG CIRCLE TO ME!!! By the way the above is from experience not hearsay!!
GOOD LUCK (just do not stop trying)

I assume you have the VIN - although I don't know if it should be advertised on an open forum. What do others think?

I take it that it was stolen in WA, and not another state? I did see a similar camper with just (SA---) on the rego plates, but that was in melb. Was being pulled by a white playdo 4wd. Found it interesting to see a car regoed in melb pullling such a trailer....

Whilst I don't know what Challenge are actually doing this minute about it, I would hope that Challenge, or a friend of Challenge may be watching this forum. The poor publicity generated throughout this community i.e. their target market, should be enough to see a positive response from them. Word spreads fast in 4WD circles.
Hope you get your trailer back. If not, hope you get compensation to buy a different brand next.
If they come good with compensation, make sure you let us all know.
Cheers,
Andy

Mate contact a soliciter, a good one. pay the 200 or what ever now. dont let more time pass
you need to have him draft up a letter of demand for the goods. or what the equiv is in SA. send them the letter via registerd mail. you may also be able to send this to their insurance agency
at the same time take in your INS policy and have him look at it with you in regards to clause's.
now you have a standing for legal action. in vic you can file a small claims suit against a bis or person for $32 and go to VCAT which is a tribunal. SA shoudl have an equive. but the limit for the tribunal is 10-15k i cant remember the exact figure.

Thanks for the messages and advice. We purchased from sa we live in nsw. We have tried today tonight and ACA and are waiting for response. Dept of fair trading was a waste of $60. They told us to wait for their insurance to pay up, their insurance does not cover it. We did get a police report.
When we picked up the in december camper we were informed that it was damaged but to take it for our planned trip to vic high country over new year. We had a fantastic time and enjoyed the camper better than a tent as I was 6 months pregnant at the time, and returned it to them 2 months later to be repaired as discussed. It got stolen after that.
Stupid us, trusting us did not get this agreement in writing. We also did not get insurance as we were of the understanding that if it was damaged then it would not be insurable. We know that they did not know it would get stolen but that does not help us.
Thanks again for the advice and we will be taking it further if we can. We put the call out to anyone to help?
